The following are the policies that attendees must agree to in order to participate in a class. A paper copy will be provided upon visiting our physical location and must be signed prior to the class. Attendees who are unable to sign will have their class cancelled and refunded.

Your health and safety are the number one priority for all of us. You will be required to follow all health and safety procedures that are explained before each class. By joining a class, you agree to abide health and safety standards set by OSHA and the CDC. This includes but is not limited to masks, protective hearing, gloves, and protective eye wear. All protective measures are required when necessary for your health and safety.

Covid-19 participation

  1. If you have been sick OR have been in contact with someone recently sick, please make sure to wait 2 weeks before joining us.
  2. Protective masks are optional, inside the building, unless required by OSHA for materials that contain VOCs.

Waiver and Release of Liability

WAIVER AND RELEASE OF LIABILITY

IN CONSIDERATION OF the risk of injury that exists while participating in RESIDENTIAL CONSTRUCTION EDUCATION & TRAINING CLASSES (hereinafter the "Activity”); and

IN CONSIDERATION OF my desire to participate in said Activity and being given the right to participate in same:

I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, "Releasor," "I" or "me", which terms shall also include Releasor’s Parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity; and

I HEREBY release and forever discharge PLANBPARTONE LLC D/B/A HOME REPAIR LAB located at 814 E NC Highway 54, Durham, North Carolina 27713, their affiliates, managers, members, officers, directors, agents, attorneys, employees, staff, volunteers, heirs, representatives, predecessors, successors, and assigns (collectively "Releasees"), from any physical or psychological injury that I may suffer as a direct or indirect result of my participation in the aforementioned Activity.

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I ASSUME FULL RESPONSIBILITY FOR ANY INJURIES OR DAMAGES RESULTING FROM MY PARTICIPATION IN THE ACTIVITY, INCLUDING RESPONSIBILITY FOR USING REASONABLE JUDGMENT IN ALL PHASES OF PARTICIPATION OF THE ACTIVITY.  I AM AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE ACTIVIY, OR FROM CONDITIONS AT THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY.

I FURTHER AGREE to indemnify, defend, and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs.

I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I should require medical care or treatment, I authorize Plan B Part One LLC d/b/a Home Repair Lab to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

I FURTHER ACKNOWLEDGE that this Activity may test of a person’s physical and/or mental abilities and limits, and may carry with it the potential for death, serious injury, and property loss. I understand there are inherent risks associated with participating in the Activity, including but not limited to the use of power tools, hand tools, sharp objects, hot water, electricity, and ladders.  I acknowledge and assume the risks involved in these and other skills and tasks relating to the Activity, and for any damage and/or injury resulting from such risks.  I agree not to participate in the Activity unless I am medically able and properly trained, and I agree to abide by the decision of the Plan B Part One  LLC d/b/a Home Repair Lab official or agent, regarding my approval to participate in the Activity.

I FURTHER ACKNOWLEDGE that the skills and tasks participated in by me as part of the Activity, to the extent that I engage in such skills and tasks at any location other than the Activity training center (including but not limited to at my home, business, or any other location), will or may be engaged in voluntarily by me, and that the Releasees have no responsibility or liability whatsoever for my participating in any such skills or tasks.

 I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO THE FULLEST EXTENT PERMITTED BY LAW TO RELEASE AND DISCHARGE Plan B Part One  LLC d/b/a Home Repair Lab AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, OFFICERS, DIRECTORS, AGENTS, ATTORNEYS, EMPLOYEES, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING LEGAL ACTION AGAINST Plan B Part One  LLC d/b/a Home Repair Lab FOR PERSONAL INJURY OR PROPERTY DAMAGE.

To the extent that statute or case law does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Plan B Part One LLC d/b/a Home Repair Lab, its agents, and employees.

I agree that this Release shall be governed for all purposes by North Carolina law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements.

In the event that any damage to equipment or facilities occurs as a result of my or my family’s or my agent's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness.

THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN THE ACTIVITY, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION.

THIS AGREEMENT was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both Participant, _______________ and Plan B Part One  LLC d/b/a Home Repair Lab agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted to alter or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.

In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed, and enforced as so limited.

Terms and Conditions

Home Repair Lab (“HRL”) hereby lists and details the terms and conditions for use of its website, including its privacy policy to describe how and why it obtains, stores, and processes data which can or may identify users.  The term “user” in these Terms and Conditions refers to visitors to the website ________________.

The HRL name and reputation was built for the establishment of good trust. These Terms and Conditions describe how HRL may collect, use and disclose personal information of users through its website, ______, and any other applications and/or online services HRL may develop that link to these Terms and Conditions (collectively, the “Sites”), and through our programs and in our learning center (“Services”). Through its Services, HRL and its authorized agents, employees and assignees may photograph, videotape, audio record, televise, duplicate, and/or transfer to any present or future technology, your likeness, and you agree that HRL, its authorized agents, employees and assignees may use the photographs, videotapes, written reviews and/or audio recordings prepared to reproduce, exhibit, publish, or distribute in such a manner as it deems fit. Unless agreed upon by HRL in advance in writing, no compensation will be paid for this use.  You also waive any right to inspect or approve the finished photographs or electronic matter that may be used in conjunction with them now or in the future, whether that use is known or unknown to you. What Type of Information does HRL Collect? 

Personal Information that may be collected by HRL may include:

  • Name, mailing address, phone number, and e-mail address
  • If you elect to provide - Birthday and Anniversary dates
  • If you buy goods or Services at our learning center or through our website/mobile program - what you buy, where you buy, how frequently you buy, etc.
  • If using a mobile device - information such as your device ID, your location, and location data relating to proximity to our learning center may be gathered
  • If you take a survey or interact with us in various other ways - demographics information and information about subjects that may interest you

We may automatically collect website/mobile app use information when you visit our Sites. This information may include information about your Internet service provider, your operating system, browser type, domain name, Internet protocol (IP) address, your access times, any website that referred you to us, the Web pages you request, and the date and time of those requests. The data is collected as a whole rather than individually.  By tracking this information, we can develop a more effective website experience for our users.  This website browsing information is not used or intended to track user-specific, personal information.

Our collection of website use information may involve the use of cookies and Web beacons. Cookies are small data files stored on your hard drive by a website to, among other things, help us improve our Sites and your experience. In addition, this Site uses Targeting or Advertising cookies to see which areas and features are popular and to count visits to our Sites. What Choices Does HRL Offer About Personal Information?

  • Follow the opt-out instructions in promotional emails we send you. If you opt out of receiving promotional communications from us, we may still send you non-promotional communications such as emails about your accounts or our ongoing business relations.

How is Personal Information Secured?

HRL takes reasonable steps to maintain appropriate physical, technical and administrative security to help prevent loss, misuse, unauthorized access, disclosure or modification of personal information.  The Sites which store collected information have industry-standard security measures in place to protect against the loss, misuse, and alteration of the information under HRL’s control.  All of the information we collect is either stored electronically or is restricted in our offices.  Only personnel who need the information to perform a specific job are granted access to personally identifiable information.  However, no data transmission over the Internet cannot be guaranteed to be totally secure.  HRL strives to protect your personal information, but we cannot ensure or warrant any information which you send to us, and you do so at your own risk.  While we take these reasonable efforts to safeguard your personal information, no system or transmission of data over the Internet or any other public network can be guaranteed to be 100% secure.

HRL is committed to keeping personal information as secure as possible during commerce transactions that involve credit card information.  Therefore, certain sections of the Sites may encrypt data using SSL or a comparable standard for all direct transactions that involve credit card or banking information.  This process allows HRL to send your credit card number and personal data over the Internet securely.  Once encrypted, only the credit card's authorization company has the ability to decrypt it.  HRL never displays your credit card number online.  Additionally, we store any personal information you have submitted on forms (i.e., your address, e-mail and billing information) on our secure server.

Privacy Policy Updates

We may update this privacy policy from time to time. When we do so, we will post the new privacy policy on this page and change the date at the top of the policy. We encourage you to check the date of our privacy policy when you visit this Site for any updates or changes. We will notify you of any modified versions of the privacy policy that might materially affect the way we use or disclose your personal information.

Refund Policy:

Due to the supplies and preparation needed for each of our classes, we have a strict no-refund policy. All sales are final.

Reservations Policy:

All attendees are required to have an advanced reservation. Reservations can be made online or by calling the location you wish to attend.

Attendance/ No Show Policy: Instruction begins according to reservation times and we are committed to delivering a complete class. Therefore, we ask that you arrive 10 minutes BEFORE class. This will make sure you have adequate time to check in before instruction begins. Any guest that does not attend their reserved session or reschedule according to our policy will forfeit the missed session.

Cancellation/Rescheduling Policy:

If you can’t make it to a Service you registered for, let us know as soon as possible.  If you contact us more than 48 hours before the event is scheduled, we will be happy to move you to an event that works better for your schedule or issue a credit good towards any future event. Cancellation requests made within 48 hours of an event will not be honored, unless we have a waiting list and can fill your slot(s).

Chargeback Policy:

All references to a “chargeback” refer to a reversal of a credit or debit card charge placed on the Sites and/or at the Services initiated by You. There is no reason for a chargeback to ever be filed. If you feel that your credit or debit card was used fraudulently on the Sites or at the Services, please contact HRL for immediate resolution.

YOU AGREE THAT YOU WILL NOT CHARGEBACK ANY AMOUNTS CHARGED TO YOUR CREDIT OR DEBIT CARD ON THE SITES OR FOR THE SERVICES. IF YOU CHARGEBACK A CREDIT OR DEBIT CARD CHARGE FOR A PAYMENT INITIATED BY YOU OR ANY AUTHORIZED USER OF THE CREDIT OR DEBIT CARD, YOU AGREE THAT HRL MAY RECOVER THE AMOUNT OF THE CHARGEBACK IN ADDITION TO FEES BY ANY MEANS DEEMED NECESSARY, INCLUDING, BUT NOT LIMITED TO, RECHARGING YOUR CREDIT OR DEBIT CARD OR HAVING THE AMOUNT RECOVERED BY A COLLECTION AGENCY.
